SB 684 and SB 1123
Up to 10 small homes you can sell one by one
Split the land into as many as 10 small lots, build a home on each, and sell them as houses with their own deeds. City staff approve the map, with no hearing.
Gov. Code 66499.41, 65852.28
In force. Some limits change on 1 January 2027 under the 2026 amendments (SB 1090 and SB 1116); this page will change with them.

- SB 684: a lot zoned for apartments, up to 5 acres.
- SB 1123: an empty lot zoned single-family, up to 1.5 acres.
- 10 lots and 10 homes at most.
- The map is approved by staff, with no hearing. The City has 60 days to decide.

What you can build
- Build the homes with no setback between them. The building code decides the gap.
- Skip parking within a half-mile of transit; elsewhere 1 space per home at most, never required to be covered.
- Pull building permits before the final map records.
- Keep an existing building on a remainder parcel that doesn't count toward the 10.
- Sell each home on its own lot. Nobody has to live there.
What it doesn’t allow
- Use land in a High or Very High fire hazard zone.
- Use a lot where a tenant lived in the last 5 years, even if the building is gone, or any rent-controlled or income-restricted housing.
- Call a single-family lot empty if it has a house someone can live in. Vacant means no permanent building, unless it is abandoned and uninhabitable.
- Build fewer homes than the floor: at least 66% of the zone's maximum density, or the count the City's housing element gives the site.
- Split a lot that came from an earlier SB 9 split or from this law.
- On an SB 1123 lot, go over the City's height limit.

What does SB 684 and SB 1123 mean for your lot?
The lot report doesn't size an SB 684 or SB 1123 project yet. It does give your zone, lot area and fire map, the first tests this law asks.
